Acceptance of Terms
By downloading, installing, accessing, or using the tinerary™ mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the App.
These Terms constitute a legally binding agreement between you and Joshua Kostreva, operating as tinerary™ ("we," "us," or "our").
Apple App Store Terms (Required EULA Overlay)
If you downloaded the App from the Apple App Store, you acknowledge and agree that:
- These Terms are between you and tinerary™, not Apple
- Apple has no obligation to provide maintenance or support
- Apple is not responsible for any claims related to the App
- Apple is not responsible for App functionality, safety, or legality
- Apple is a third-party beneficiary of these Terms and may enforce them
Your use of the App must comply with Apple's App Store Terms of Service.
Description of the Service
tinerary™ is a digital coordination and planning tool that enables users to create, share, and collaborate on itineraries, events, and plans.
tinerary™ does not:
- Act as a travel agent, booking service, or event organizer
- Verify times, locations, or user-submitted information
- Guarantee attendance, punctuality, safety, or outcomes
- Supervise events or interactions
- Screen or background-check users
All content is user-generated and provided "as is."
Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
User Accounts and Responsibility
You are solely responsible for:
- All activity conducted under your account
- Securing your device and Apple ID
- Decisions made using App information
- Your interactions with other users
We are not responsible for unauthorized access resulting from device loss, theft, or misuse.
User-Generated Content
Ownership
You retain ownership of any content you create or submit within the App ("User Content").
License
By submitting User Content, you grant tinerary™ a non-exclusive, royalty-free, worldwide license to store, display, transmit, and process such content solely for the purpose of operating the App.
Responsibility
You are solely responsible for your User Content and any consequences resulting from it. We reserve the right, but not the obligation, to remove content at our discretion.
Prohibited Uses
You agree not to use the App to:
- Violate any law or regulation
- Harass, threaten, defame, or abuse others
- Share illegal, obscene, or harmful content
- Upload malware or interfere with App systems
- Misrepresent events, locations, or intentions
- Facilitate unsafe, illegal, or dangerous activities
- Reverse engineer, scrape, or exploit the App
Violations may result in immediate suspension or termination.
No Reliance and No Guarantees
The App is provided "AS IS" and "AS AVAILABLE."
We make no warranties or representations regarding accuracy, reliability, availability, safety, or outcomes. Any reliance on the App or its content is entirely at your own risk.
Safety and Assumption of Risk
You acknowledge that events, gatherings, or meetings arranged through the App may involve inherent risks. You voluntarily assume all risks associated with participation.
tinerary™ does not ensure personal safety, supervise gatherings, or provide emergency services.
No Insurance or Professional Services
tinerary™ does not provide insurance coverage of any kind and does not offer professional, legal, travel, safety, or emergency services. You are solely responsible for obtaining any insurance you deem necessary.
Third-Party Services
The App relies on third-party services including Apple CloudKit and Google Firebase.
We are not responsible for third-party downtime, failures, changes, errors, or data loss. Use of third-party services is governed by their respective terms and policies.
Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any reason.
You may stop using the App at any time by deleting it from your device.
Disclaimer of Warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for personal injury, death, emotional distress, or property damage
- We shall not be liable for lost profits, lost data, missed events, missed travel, or opportunities
- We shall not be liable for indirect, incidental, special, or consequential damages
Our total liability shall not exceed one hundred dollars (USD $100) or the amount you paid us, if any, whichever is greater.
Indemnification
You agree to defend, indemnify, and hold harmless tinerary™ and Joshua Kostreva from any claims, damages, losses, liabilities, or expenses arising from:
- Your use of the App
- Your User Content
- Your interactions with other users
- Events you create, attend, or promote
- Your violation of these Terms
Binding Arbitration and Class Action Waiver
Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration, except for matters eligible for small-claims court.
You agree that disputes will be resolved only on an individual basis and waive any right to participate in class actions, class arbitrations, or representative proceedings.
Jury Trial Waiver
To the fullest extent permitted by law, you waive any right to a jury trial in any legal proceeding arising out of or relating to these Terms or the App.
Governing Law and Venue
These Terms are governed by the laws of the United States and the State of Ohio, without regard to conflict-of-law principles.
Any permitted court proceedings shall be brought exclusively in courts located in the State of Ohio, unless otherwise required by law.
Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, network failures, government actions, labor disputes, or third-party service interruptions.
Assignment
We may assign or transfer these Terms without restriction. You may not assign these Terms without our prior written consent.
No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
Survival
Provisions relating to liability, indemnification, dispute resolution, governing law, and venue survive termination of these Terms.
Entire Agreement
These Terms constitute the entire agreement between you and tinerary™ regarding use of the App and supersede all prior agreements or understandings.
